California Notary Acknowledgment

The form most frequently completed by a California Notary Public is the certificate of acknowledgment, provided in California Civil Code section 1189. The Acknowledgment certifies the following: (1) the signer personally appeared before the Notary on the date indicated and, in the county, indicated, (2) identity of the signer; and (3) the signer's acknowledgment to the Notary that the signer executed the document.

California Notary Jurat

The second most frequently used form is the Jurat, according to Government Code section 8202. The Jurat includes the wording “Subscribed and sworn to (or affirmed)." In the Jurat, the Notary certifies: (1) the signer personally appeared before the Notary on the date indicated and, in the county, indicated, (2) instrument was signed in the Notary's presence, (3) Notary administered the oath or affirmation, and (4) identity of the signer was verified by Government issued identification, the notary's personal knowledge or two subscribing witnesses.

Notary Public FAQ’s

  • Simply put, a notary serves as an unbiased witness during the taking of acknowledgements and/or affidavits, the signing of documents, and the administration of oaths. A notary public must finish and pass a course of study and a state examination in order to be appointed as an official of the state.

  • California says the signer must personally appear before the notary for the notarization. The notary and signer must both be physically present, face to face in the same room. According to (Civil Code section 1189 and Government Code section 8202) When preparing a certificate of acknowledgment, the document can be executed before the person brings it to a notary for notarization. In an acknowledgment, the signer must personally appear before a notary and acknowledge that the signer executed the document, not the signer executed the document in the notary presence.

  • The Jurat is identified by the wording “Subscribed and sworn to (or affirmed )“ contained in the form. The notary certifies: the person requesting the Jurat must appear before a notary, take an oath, and sign the document in the presence of a notary and to the identity of the signer.

  • In California, a notary public may notarize documents for relatives or others, unless doing so would provide a direct financial or beneficial interest to the notary public. Care should be exercised if notarizing for a spouse or a domestic partner due to California’s community property law.
